CodeGlow is firmly committed to maintaining compliance with all applicable intellectual property laws, including the United States Digital Millennium Copyright Act (DMCA). We understand the importance of copyright protection for content creators and take allegations of infringement seriously. Upon receipt of a proper DMCA notification, we will respond swiftly by removing or disabling access to the allegedly infringing material, as mandated by Section 512 of the U.S. Copyright Act.
We also reserve the right to notify the alleged infringing party, including sharing the full content of the original DMCA notice. This notice may contain the reporting party’s name, address, and other contact details. Our intent is to facilitate a fair process, allowing both parties to resolve disputes in a lawful and civil manner.
Filing a DMCA Notice
To file a DMCA notice, your written complaint must include the following:
- A signature (physical or electronic) of the person authorized to act on behalf of the copyright owner;
- A description of the copyrighted work you claim has been infringed;
- Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material on our site (e.g., URLs);
- Your full name, mailing address, phone number, and email address;
- A statement that you have a good faith belief the disputed use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
Filing a Counter-Notification
If you believe your content was mistakenly removed, you may file a counter-notification with the following:
- Identification of the content removed and its original location;
- Your name, address, phone number, and email;
- A statement under penalty of perjury that you believe the removal was a result of mistake or misidentification;
- A declaration that you consent to the jurisdiction of a U.S. Federal Court for your address or, if outside the U.S., any jurisdiction in which the service provider is located;
- Your physical or electronic signature.
Failure to comply with these steps may result in delays. We encourage all parties to ensure the accuracy and validity of their submissions.
